The Short Version
BenefitPath is an information tool, not a professional advisor. We use AI to help you understand government benefits and generate documents - but AI can make mistakes. You must review and verify all AI-generated content before using it. We do not provide legal, medical, tax, or financial advice. Always consult qualified professionals for advice specific to your situation. We are not liable for decisions you make based on information provided by this app. Our total liability to you is limited to the amount you paid for the service.
1. Acceptance of Terms
By accessing or using BenefitPath.ca (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and 14622472 Canada Inc. (“we,” “us,” “our”).
2. Nature of the Service
BenefitPath is an information and organizational tool. It is not a law firm, accounting firm, medical practice, tax advisory service, immigration consultancy, or licensed financial advisory service. We do not provide legal advice, medical advice, tax advice, or financial advice.
The information provided through BenefitPath is for general informational and educational purposes only. It is based on publicly available government criteria and should not be relied upon as a substitute for professional advice from a qualified lawyer, accountant, tax professional, medical practitioner, or licensed financial advisor.
No information provided by BenefitPath - whether through the eligibility scan, the benefits roadmap, the DTC Application Coach, the AI Language Coach, the AI Chat, the Appeal Toolkit, provincial guides, or any other feature - constitutes professional advice or creates a professional-client relationship of any kind.
You acknowledge and agree that: (a) BenefitPath provides general information about Canadian government benefit programs based on publicly available eligibility criteria; (b) your eligibility for any benefit program is determined solely by the relevant government authority (such as the Canada Revenue Agency, Service Canada, or your provincial government), not by BenefitPath; (c) BenefitPath's eligibility scan results are estimates only and do not guarantee that you will be approved for any benefit; (d) government benefit programs, eligibility criteria, rates, and application processes change frequently, and while we endeavour to keep our information current, it may not reflect the most recent changes; and (e) you should always verify information provided by BenefitPath with the relevant government authority or a qualified professional before making any decisions or taking any action.

3. AI-Generated Content
BenefitPath uses artificial intelligence (AI) technology, specifically large language models provided by Anthropic (Claude), to generate content including but not limited to: functional limitation descriptions for DTC applications (Language Coach), suggested text for appeal and objection letters, responses to questions in the AI Chat, medical practitioner guide documents, and explanations of benefit eligibility and application processes.
AI-generated content may contain errors, inaccuracies, omissions, or outdated information. AI models can produce responses that appear authoritative but are factually incorrect. This is a known limitation of current AI technology.
You are solely responsible for reviewing, verifying, and editing all AI-generated content before using it for any purpose. This includes, without limitation, reviewing all suggested functional limitation descriptions before sharing them with a medical practitioner, verifying all information in generated documents (such as the Medical Practitioner Guide) before printing or distributing them, confirming all eligibility information with the relevant government authority, and having any appeal or objection letters reviewed by a qualified professional before submission.
We strongly recommend that you consult with a qualified lawyer, accountant, or other professional before submitting any document generated by or based on content from BenefitPath to a government authority.

AI can make mistakes. You must review, verify, and edit all AI-generated content before using it, printing it, or sending it to a government authority or medical practitioner.
4. Medical Disclaimer
BenefitPath does not provide medical advice, diagnosis, or treatment. The functional limitation descriptions generated by the AI Language Coach are suggested text for discussion with your medical practitioner - they are not medical assessments. Your medical practitioner makes the final clinical determination about your functional limitations and is solely responsible for the accuracy of the medical information they certify on any government form (including the T2201 Disability Tax Credit Certificate, provincial Disability Determination Packages, and any other medical assessment forms).
BenefitPath does not evaluate, assess, or determine whether you have a disability. We provide tools to help you describe the effects of your condition in the language that government agencies evaluate - but the medical determination of disability is made by qualified medical practitioners, and the administrative determination of benefit eligibility is made by the relevant government authority.
5. Tax and Financial Disclaimer
BenefitPath does not provide tax advice, tax preparation, or financial planning services. The estimated benefit values shown in the eligibility scan results and throughout the Service are approximations based on publicly available government schedules and the information you provided. Actual benefit amounts may differ significantly based on your individual circumstances, tax situation, and the decisions of the relevant government authorities.
We do not calculate your taxes, prepare tax returns, or advise on tax strategies. Information about tax credits (including the Disability Tax Credit), benefit amounts, clawback thresholds, and RDSP projections is provided for general informational purposes only. You should consult a qualified tax professional or accountant for advice specific to your tax situation.
6. Limitation of Liability
To the maximum extent permitted by applicable Canadian law:
- 14622472 Canada Inc., its directors, officers, employees, agents, and affiliates (collectively, the “BenefitPath Parties”) shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
- The BenefitPath Parties shall not be liable for any damages, losses, or costs arising from: your reliance on any information provided by the Service, including AI-generated content; any errors, inaccuracies, or omissions in the information provided; any denial or delay in the processing of a benefit application; any decision by a government authority regarding your eligibility for any benefit program; any action or inaction by a medical practitioner based on content generated by the Service; any tax consequences resulting from your use of or reliance on information provided by the Service; or any changes to government programs, eligibility criteria, or benefit amounts that are not yet reflected in the Service.
- In no event shall the total aggregate liability of the BenefitPath Parties to you for all claims arising out of or relating to the Service exceed the amount you actually paid to BenefitPath for the Service in the twelve (12) months preceding the event giving rise to the claim.
- The limitations in this section apply regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, or any other legal or equitable theory, and whether or not the BenefitPath Parties have been advised of the possibility of such damages.
Limitation of liability
Our total liability to you is limited to the amount you actually paid for the service in the twelve months before the issue that gave rise to the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless the BenefitPath Parties from and against any and all claims, demands, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your reliance on any information provided by the Service without independent verification; (c) any content you submit to the Service (including information provided in the eligibility scan and AI Chat); (d) your violation of these Terms; (e) your violation of any rights of any third party; or (f) any document or submission you make to any government authority or other party based in whole or in part on content generated by the Service.
8. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the information provided will be accurate, complete, current, or reliable; (c) the results of the eligibility scan will accurately predict your actual eligibility for any benefit program; (d) any AI-generated content will be free from errors, inaccuracies, or omissions; (e) the Service will meet your specific requirements; or (f) any errors in the Service will be corrected.
9. User Responsibilities
By using the Service, you agree that you are responsible for:
- providing accurate and truthful information in the eligibility scan and throughout your use of the Service;
- reviewing and verifying all AI-generated content before using it for any purpose;
- consulting qualified professionals (lawyers, accountants, medical practitioners, financial advisors) for advice specific to your situation;
- confirming your eligibility for any benefit program with the relevant government authority before relying on information from the Service;
- proofreading all documents generated by the Service (including the Medical Practitioner Guide, appeal letters, and any other generated documents) before printing, distributing, or submitting them;
- maintaining the security of your account credentials; and
- complying with all applicable laws and regulations.
10. Payments and Refunds
BenefitPath offers one-time payment plans as described on the pricing page at the time of purchase. Payments are processed securely through Stripe, Inc. All prices are in Canadian dollars (CAD) and include applicable taxes.
Due to the digital nature of the Service, all sales are final. We do not offer refunds once you have accessed paid features of the Service. If you experience a technical issue that prevents you from accessing features you have paid for, please contact us at support@benefitpath.ca and we will make reasonable efforts to resolve the issue.
If you purchased a monthly installment plan, you are committed to the full payment schedule. Cancelling a monthly installment plan before all payments are complete does not entitle you to a refund of payments already made, and access to paid features may be restricted until the remaining payments are completed.
11. Account Termination
You may delete your account at any time through Account Settings. Upon deletion, we will permanently remove your personal data as described in our Privacy Policy.
We reserve the right to suspend or terminate your account if we reasonably believe that: (a) you have violated these Terms; (b) your use of the Service poses a security risk to the Service or other users; (c) you are using the Service for fraudulent or illegal purposes; or (d) continued provision of the Service to you is no longer commercially viable.
12. Intellectual Property
The Service, including its design, code, content, features, and documentation, is owned by 14622472 Canada Inc. and is protected by Canadian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms.
Content generated by the AI features of the Service (such as functional limitation descriptions, appeal letters, and practitioner guides) is generated for your personal use. You may use, modify, and distribute this generated content as needed for your benefit applications. However, you may not resell, commercially distribute, or use AI-generated content to create a competing service.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
Before initiating any legal proceeding, you agree to first contact us at support@benefitpath.ca and attempt to resolve the dispute informally for a period of at least thirty (30) days.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting a prominent notice on the website and, for registered users, by email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
